Terms and conditions

These terms and conditions (“Terms”) apply to fundraising events organised by third parties (“Event Organiser”) in which participants (“Participant”) fundraise on behalf of Young Epilepsy (each a “Third Party Event”). For the avoidance of doubt, events organised by Young Epilepsy itself shall be governed by separate terms and conditions.  

By registering for the Third Party Event, Participants agree to be bound by these Terms, in addition to the Event Organiser’s own terms and conditions, which must be fully complied with at all times. 

Participants must meet the set minimum age requirement on the date of the Third Party Event as set out within the description of each Third Party Event (whether provide by Young Epilepsy or the Event Organiser) and must ensure they are medically and physically fit to take part in the Third Party Event activities.  

Participants must complete the registration process made available to them in relation to the Third Party Event and pay any applicable registration fee due to Young Epilepsy and / or the Event Organiser. Any registration fees payable to Young Epilepsy are non-refundable and do not count towards Participants’ fundraising totals. You acknowledge that failure to respond to communications from Young Epilepsy about completing your registration or fundraising (including paying any applicable registration fees) will put your participation at the Third Party Event at risk.  

Participants pledge to meet a minimum fundraising target for the Third Party Event as specified by Young Epilepsy on their event webpage. This excludes Gift Aid or similar tax-efficient schemes. Any monies raised in connection with the Third Party Event are held on trust for Young Epilepsy. You have a legal responsibility to ensure that all sponsorship funds collected or raised in connection with the Third Party Event are paid to Young Epilepsy as soon as possible and in any event no later than six weeks after the date on which the Third Party Event is scheduled to take place. If you do not pay all sums due to Young Epilepsy under these Terms by the due date Young Epilepsy will take all such steps it considers appropriate to recover all outstanding amounts from you. Young Epilepsy reserves all other rights and remedies available to it at law to recover any unpaid sums and / or to recoup its costs further to your late payment. Unless otherwise agreed by us in writing, all fundraising activity undertaken by you as part of the Third Party Event and further to your registration must be for the benefit of Young Epilepsy only.

Participants agree to conduct themselves in a manner that upholds the integrity of Young Epilepsy and the Third Party Event. They must comply with all applicable laws and regulations and follow the instructions of the Event Organisers at all times. 

(a) Subject to paragraph (b), Young Epilepsy and its agents or representatives shall not be liable for:

i.  any injury, loss, or damage suffered by participants as a result of their participation in the Third Party Event, except where such injury, loss, or damage is caused by the negligence of Young Epilepsy;

ii. any loss or damage sustained by a Participant as a result of the cancellation of the Third Party Event for any reason, any changes made to the Third Party Event for safety or any other reasons; or any circumstances beyond the reasonable control of Young Epilepsy. 

(b) Nothing in these Terms shall limit or exclude Young Epilepsy’s liability for: (i) death or personal injury caused by negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any other liability which cannot be limited or excluded by applicable law.

Participants are strongly advised to obtain personal accident insurance and to ensure their belongings are covered, as Young Epilepsy accepts no responsibility for loss or damage to personal property further to your participation at the Third Party Event or otherwise. 

Personal information collected during registration and further to your participation at the Third Party Event will be used and processed in accordance with Young Epilepsy’s  Privacy Notice  and relevant data protection legislation. You acknowledge that you may be contacted by email, phone, SMS and post in relation to the Third Party Event you have registered for, ensuring Young Epilepsy can deliver the necessary event-related communications required to complete your successful participation and fundraising for the Third Party Event. You acknowledge that Young Epilepsy will share your contact details with the relevant Event Organiser further to your participation at the Third Party Event. We will not share your data with any other third parties or use it in any other way, except as permitted or required by law or as otherwise set out in our Privacy Notice. 

You acknowledge and agree that any Third Party Event may be cancelled, altered, or otherwise changed by the relevant Event Organiser at any time and that such matters are beyond Young Epilepsy’s control.  Young Epilepsy will endeavour to inform Participants of any cancellations or material changes to Third Party Events that it is aware of but Participants agree that Young Epilepsy have no obligations and accept no liability in relation to the same. 

Participants grant Young Epilepsy a perpetual, royalty-free, worldwide, non-exclusive right to use any photographs, video, or audio recordings taken during the Third Party Event (“Media”) for promotional, fundraising and marketing purposes, including on Young Epilepsy's website and social media channels. If you do not consent to the use of Media in this way, please notify Young Epilepsy of this during your completion of the registration process. 

Participants must adhere to any specific rules set out for the Third Party Event, including route regulations, equipment requirements, time restrictions, and any applicable Event Organiser terms and conditions. 

If a Participant wishes to cancel their registration, they must inform Young Epilepsy and the Event Organiser as soon as possible using the following contact details: events@youngepilepsy.org.uk. You acknowledge and accept that any registration fee paid to Young Epilepsy is non-refundable.  If sponsorship money was given on the condition you participate in / complete the Third Party Event, and the Third Party Event is cancelled, or you do not participate in / complete the Third Party Event, then you must contact relevant donors and ask if they are still happy for sponsorship monies to go to Young Epilepsy. If they do not wish for their sponsorship money to go to Young Epilepsy in this circumstance, then the donation must be refunded to the relevant donors. If the sponsorship money was given without any conditions attached, and the Third Party Event is cancelled, or you do not participate in / complete the Third Party Event, the money should be paid to Young Epilepsy regardless and there is no obligation to contact or confirm this with donors. 

Participants take part in the Third Party Event at their own risk, and  are solely responsible for ensuring they are physically prepared and medically fit to take part in the Third Party Event. You must not participate if you are unwell or have been advised against physical activity or taking part in the Third Party Event by a medical professional. Should any medical or physical condition arise prior to the Third Party Event which is likely to affect your ability to participate in the Third Party Event, you should withdraw from the Third Party Event. You acknowledge and agree that Young Epilepsy and Event Organisers reserve the right to remove any Participant from a Third Party event for safety reasons or if they reasonably believe it is in the best interests of the Participant (for example, where a Participant is deemed unfit to continue a Third Party Event). 

(a) Young Epilepsy reserves the right to withdraw a Participant’s place in the Third Party Event if they breach these Terms, fail to meet fundraising expectations without reasonable explanation, or act in a way that could bring Young Epilepsy into disrepute.

(b) No registration fee will be refunded in the event that a Participant elects to withdraw from the Third Party Event for any reason. 

(c) Registrations to participate in the Third Party Event are non-transferable to another year or a future date. Participation in the Third Party Event is personal to each Participant, and you are strictly prohibited from swapping, selling, or transferring your place in the Third Party Event or allowing any other person to participate in your place, unless Young Epilepsy gives its prior written consent. 

(d) If you elect to withdraw from the Third Party Event, you must send written confirmation of your withdrawal via letter or email to events@youngepilepsy.org.uk. 

Young Epilepsy shall not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, pandemics, extreme weather, or actions of third parties.

We may amend these Terms at any time by updating this page, so please check this page regularly. By continuing to participate and be signed up for the Third Party Event, you will be deemed to have consented to and accepted any amendments to these Terms with effect from the date of the amendment. 

A delay or failure to exercise, or the single or partial exercise of, any right or remedy of Young Epilepsy does not waive that or any other right or remedy of Young Epilepsy, nor does it prevent or restrict the further exercise of that or any other right or remedy of Young Epilepsy.

These Terms and any disputes or claims (including non-contractual disputes or claims) arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
